The Circuit Court in St. Louis County issued an order stopping the operation and enforcement of HB1413. A lawsuit was filed by a number of organizations in August 2018 challenging the constitutionality of HB1413.
The effect of the order is to keep the Department of Labor and Missouri State Board of Mediation from enforcing and administering any provision of HB1413. This prohibition includes the provisions on election, payroll deduction, bargaining and reporting.
What does this mean?
The short answer is that Missouri schools revert back to the rules pre-HB1413. While we have not had a chance to talk with any school district attorneys, MSBA or the State Board of Mediation, CTAs can now discuss salaries and working conditions with their administrators.
The preliminary injunction remains in effect until a final order is entered by a Court. There is no timeline for that decision.
